Vela Córdova, d/b/a Vela Córdova Law, subject to its Terms of Use (TOU), available here.  This Privacy Policy (the “Policy”) concerns our practices with regard to the privacy of information that you provide to us by using the website.  It is your responsibility to read this Policy and the TOU carefully before using the website.  Several important words or phrases used in this Policy are defined in the TOU, while others are defined below, and it is necessary that you read this Policy with those definitions in mind.  Your use of the website is subject to this Policy as well as the TOU, and, by using the website, you agree to be bound by this Policy and the TOU.

Scope of this Policy

This Policy only covers issues related specifically to your privacy in connection with your use of the website.  It does not cover other issues.  For example, and without limitation, this Policy does not cover: (i) issues concerning the intellectual property rights related to the information that you may provide to us; (ii) information that you may provide to us by means other than the website; (iii) information that you provide by using other websites, even if they are mentioned, linked, or advertised on the website.

Information that We Collect and Store

When you use the website, we may collect and store the following types of information:

1.      There is a contact page that allows you to send us your name, e-mail address, and a message.

2.      There is a blog that allows you to make comments, either anonymously or while you are logged into an account with certain third parties.  If you are logged into such an account, then the information we collect and store may include information that said account has been configured to share with us, such as a user name, screen name, avatar, etc.

3.      We may collect and store your IP address, access URL, time of access, geographic location, browser type, referral URL, and other information regarding your use of the website.

The website does not use cookies or similar tracking technology.

The website does not respond to “do not track” signals.

Information that Third Parties Collect and Store

Generally, third parties are not allowed to collect information when you use the website.  However, information of the kind indicated in the previous section may be collected and stored on our behalf by third parties that provide services to us.  In addition, the website is hosted by www.squarespace.com and functions largely with their technology.  When you use the website, Squarespace, Inc. and their service providers may collect and store certain information pursuant to their privacy policies, as further explained below.

How We Use and Disclose Personally Identifiable Information

Some of the information that we collect and store is information that we consider to be personally identifiable information, that is, information that is sufficient to identify you either by itself or because we have linked it to other information about you.

We may use the personally identifiable information that we collect and store to: (i) provide, manage and improve the website’s functionality and content; (ii) identify users who are breaching the TOU; (iii) send you communications regarding the website; (iv) send you general communications related to our law practice, except that these communications will include a procedure for you to choose not to receive further communications of this kind; (v) comply with any laws or regulations, as we may deem it necessary at our sole discretion; (vi) protect any person, property or rights, including (but not limited to) our own, as we may deem it necessary at our sole discretion; (vi) transfer ownership of the website to any third party; and (vii) convert the information into non-personally identifiable information, as further explained below.

We may disclose the personally identifiable information that we collect and store to the following third parties for the purposes indicated above: (i) persons that provide services to us; (ii) governmental authorities; and (iii) persons that require the information for the referenced purposes.

To protect your personally identifiable information against unauthorized access, or to address such access once it has taken place and we have become aware of it, we will take such measures as may be required to comply with the applicable laws of the Commonwealth of Puerto Rico and the U.S. federal government.  You recognize that use of the website entails a risk of unauthorized access to personally identifiable information about you.

How We Use and Disclose Public Information or Non-Personally Identifiable Information

The policies indicated above concerning use and disclosure of information do not apply to information that we consider to be public or non-personally identifiable information.  We may use and disclose such public or non-personally identifiable information for any purpose and to any person.

We consider information to be public if you have disclosed it publicly or it has become publicly available in some other way.  This includes (but is not limited to) the information that you provide by using the comments section of the website.

We consider information to be non-personally identifiable when it is insufficient to identify you.  This may be the case because the information cannot be used in any way to identify you, or because the information is insufficient by itself to identify you and we have not linked it to other information about you.  In addition, we may aggregate, separate or otherwise manipulate the personally identifiable information that we collect and store in such a way that it is no longer sufficient to identify you, and then it is considered non-personally identifiable information.

How Third Parties Use and Disclose Information

The website is hosted by www.squarespace.com and functions largely with their technology.  They are not affiliated with us and have not endorsed us.  They have a privacy policy, available here, and said policy refers to several privacy policies of other third parties that provide services to Squarespace or are related in some other way to the services that Squarespace provides.  The information that you provide by using the website may be subject to the referenced Squarespace and other third party privacy policies, which may or may not contain terms as protective as this Policy.

Disclaimers of Representations, Warranties, and Liability

As provided above, your use of the website is subject to the TOU as well as this Policy, and, by using the website, you agree to be bound by the TOU and this Policy. This means (among other things) that the disclaimers of representations, warranties, and liability contained in the TOU are fully applicable to any matter that falls partially or entirely within the scope of this Policy.

Miscellaneous Provisions

The definitions contained in the TOU apply to this Policy insofar as the defined terms are used herein.

This Policy is governed by the laws of the Commonwealth of Puerto Rico (including all applicable U.S. federal laws), without giving effect to principles of conflict of laws.  You hereby consent to the exclusive jurisdiction and venue of the Court of First Instance of the General Courts of Justice of the Commonwealth of Puerto Rico, San Juan Region, to resolve all disputes arising under this Policy.

The headings of this Policy are to facilitate reference only.  They are not a part of this Policy, and shall not affect the interpretation hereof.

If any provision of this Policy is held to be invalid or unenforceable by any competent authority in any jurisdiction, then such provision shall be stricken and the remainder of this Policy shall remain in full force and effect.
